Trade mark Law is a branch of Intellectual Property Right. A trademark includes any word, name, symbol, or device, or any combination, used, or intended to be used, in commerce to identify and distinguish the goods of one manufacturer or seller from goods manufactured or sold by others, and to indicate the source of the goods. In short, a trademark is a brand name. Trademark is a mark or symbol which is capable of distinguishing the goods or services of one from those of others.

Indian Applicant: On determining the eligibility of the word or combination of word and design for protection under The Trade Marks Act, 1999, an Indian applicant can file the application with the Indian Trademark office.
Foreign Applicants: A foreign applicant can file application in India within six months from the date of filing the original application within his respective country. If filed later, the applicant is not entitled to claim priority date of the first application.
